Justly or unjustly, the freewheeling internet access in cyber cafes embodies both hopes and fears at a time: internet connectivity and usage is anticipated as central to long-term economic interests and development by every one and is encouraged. Fears are that unsupervised or unguided children can browse pornographic, violence, and other perniciousinfo sites, or they can become centres of some other nefarious activities and places where youngsters hang around and spend time in unproductive activities. Besides, terrorists and cyber criminals can take advantage of these cafes as they provide multiple layers of protection like public call offices.

In a latest study of "terrorism and the internet", United States' counter terrorism analyst Gabriel Weimann noted "that cyberspace has advantages for terrorist groups. First is easy access from anywhere to a very large audience around the world. The report says, "You don't even need a computer; you can just go to a public library . . . or, you can go to an internet café. There is no control, no regulation, and no laws. Nobody is censoring the messages."

Cafes provide complete anonymity. "You can sit in a coffee shop, an internet café in London, use a server in South Africa and send a message to North America, without anybody being able to trace it," he adds.

With increase in criminal activities online, discipline of cyber laws emerged some four years ago. By now more than 30 nations including the Central Asian States, China, Cuba, France, India, Japan, Malaysia, North Korea, Singapore and United States have cyber laws in place, though all may be having different inten t. Some other countries - Australia, Burma, Saudi Arabia, and Syria - have blocked pornographic sites. Gambling sites are outlawed in South Korea.

Internet café business has remained a flourishing cottage industry that requires relatively little investment. So far they have not been regulated and it is unlikely to change anytime soon,specially in the developed world. Recently, there has been a strident crackdown on net cafes in China which resulted in shutting down thousands of unlicenced cafes across the country to restrict "juveniles to enter or allowing unhealthy information to spread through internet followed by Indian government's crackdown on net café where the owners were asked "to ensure that the net cafes are not used for viewing pornography. The law is enshrined in the Information Technology Act, 2000, emailed Lubna, a journalist from India.

Vietnam government has also issues a decree (number 55) ordering net cafes to register with the Internet Services Providers. A foreign news agency has recently reported (and the story was run by many international publications) that "cyber cafes in Pakistan will soon be made accountable as the government is all set to draft a law to regulate their activities."

Consider this in order to see the relevance of any regulation for net cafes in the context of Pakistan?

Comparatively, few users can afford computers and telephone line at home in the country and an overwhelming majority go online in the net cafes where they can enjoy inexpensive services incognito. Not only that, some of those who have a net connection at home also visit the cafes.

The IT-hype created public demand that helped net café to come up in every nook and corner of towns and cities, wherever net access is available. They are of different types; high-end and cool places with comfortable working environment in posh localities or noisy and smoke chocked cubby-holes in back alleys. Those with work stations in cabins with chains, behind partition walls, monitors screens facing walls where others cannot see or in open where every one can see whatever is on others' monitors.

So far there are no comprehensive cyber laws to deal with the issues and the legal consequences on internet, the World Wide Web and cyberspace in Pakistan. Given the nature of internet, execution of any cyber law anywhere in the world is a big question mark.

Earlier, government's abortive effort to ban pornography sites in Pakistan is one case in point. But if the situation demands, making the cyber cafes accountable for the collective good of our society should not be impossible. That said; let us see what major concerns are when it comes to regulating local net cafes? What do café owners and users think about any regulation? And who will implement the law if and when it is made?

Privacy and civil liberties are generally mirrored in all discussions when it comes to controlling any aspect of internet. How privacy, civil rights and personal freedom is threatened if net cafes are run under some standard rules? Does viewing what is on others' screen endanger the basic civil liberties of others and who wants to do that? Does showing personal ID before using net facilities at public computers is a breach of privacy? Or is anonymity - using a public facility without leaving any traces to be tracked back - being categorized as privacy?

In the context of net cafés, privacy can be defined as "the state or quality of being secluded from the view and or presence of others," reads RSA Laboratories site.

Amjad Iqbal Sindhu, an advocate Lahore High Court says, "Individuals are entitled to keep to themselves what they do online or offline unless some special situation like public interest in general demands otherwise. In a civilized society, no body has the right whatsoever to snoop over others." He quoted English philosopher John Stuart Mill as saying that "the only purpose for which power can be rightfully exercised over any member of a civilized community, against his will, is to prevent harm to others."

Public places are not the best spots for privacy. "Imagine what ordinary users do when they log on; they check email and fire off replies, chat, surf some sites, brows or play games. What is there to be secretive or cautious about? However, cafes may be registered with some central authority. Seating arrangements in them should be open - screen facing outwards. This alone will clear so many doubts about the policy of any café and will define the kind of crowd that gathers there," adds Sindhu.

Café owners and proprietors think that any kind of restriction in usage or asking patrons to show and record their identities will adversely affect their business.

"This is not the best way to track back miscreants. Any one up to some thing bad can sure outmanoeuvre such barriers. Big worry is that will any rule shift the onus of customers' actions on café owners or will we be made accomplice if and when something wrong happens," says Tanvir Ahmad, a manager of "open policy" cafe in Gulgasht Colony Multan.

Imran Nazir is able to make his living through net café, despite "open policy" with all work stations in semi circle facing outwards plus cold drinks and tea, because "I am located near the University of the Punjab hostels and my clients are mostly serious student who come here for preparing their assignments. I try to provide them with an academic atmosphere in the cafe. They search, brows, download documents and get required material printed or save it on their floppy disks for later use. Or they sit her and compose their assignments," he says. On the other hand, some customers go to the cafés only for viewing porno sites or to have long sessions of chats; every one knows that.

A proprietor of the café in Lahore confessed, "I have some regular clients who can hardly read or write English but they have learnt to operate computers and internet. What do you think they do online? Stop them and they will go find another cafe. If the government has to ban pornographic sites, ISPs should be regulated and not the net cafes."

Qamar uz Zaman Khan, an owner of a cafe in Multan told, "The scene in net cafes in Multan is no different than any other city in the country. Some 70 to 80 per cent of the visitors come for entertainment whereas only 20 per cent visit for educational pursuits. Most of the visitors are male; young boys. In posh areas, however, female students are also seen visiting."

After the Rawalpindi scandal (I still get maxium search queries leading to this page about Rawalpindi Internet Scandal), the city administration here is already asking the café owners to adopt open policy and remove all partitions. Qamar suggests that separate "female only cafes" should be opened instead of removing the partitions.

Users' response to any kind of restriction in net use is mixed one. When asked some say there is no harm while some other say they will not go to the cafes if every time they have to enter identification particulars and sign a register of attendance. Given the lax law enforcement in the country, any rule is likely to be neglected both by the cyber cafe walas as well as the users," comments Tanvir Ahmad.

"I travel to different places all over the country in connection with my work and have to use net cafes to stay in constant touch with my company. I use the nearest cyber café where ever I happen to be. I will revert back to telephone if some legal procedures are introduced to use the cafes," says Fazal Qureshi, a sale representative of greeting cards publishing house. He starts from Lahore and tours the country with card albums, takes the orders from books and card sellers and sends them back to the company. He adds, "I do not want to get into legalities later on."

One more concern that was voiced during scouting is the authority that will regulate the net cafes and how. Any agency which is entrusted with the responsibility to oversee that PCs and internet are not misused at public places have to be tech savvy and should be able to stay current on technologies that are changing every day. The civil police force is not organized for such technical jobs. "Police certainly cannot do that," thinks Iqbal Sindhu.

Cyber cafés have contributed great value to spread net usage in Pakistan. If they have to be standardized, serious issues like privacy and human rights should be given due considerations when suggesting any ways internet cafés should be run and managed across the country. The matter should be discussed thoroughly between café owners and the government at an appropriate level. There should be an open and extensive public debate on the subject. The consensus should be build before any regulation is enforced. Or else we may be poised to lose a budding business and reduced Internet users' base in the country. The choice is ours.

The stats have been released from today's scrimmage and stadium test run. The teeming masses were not allowed inside to watch due to the ongoing construction.

Mikel LeShoure was the top running back with 98 yards on 14 carries and a touchdown. Crisis of Social Partnership: Collapse of National Pay Talks in Ireland

The 21 year old social partnership pact between unions, employers and the Government in Ireland is entering one of its periodic crises as one national pay agreement Towards 2016 begins to run out and talks on a successor have collapsed. The Government is expected to attempt resuscitation in late August or early September, writes Padraig Yeates.
Calls are being made for the social partners to invoke the spirit of 1987, but a lot has changed since then. In 1987 things were so bad that the Government was about to run out of funds to make social welfare payments, unions had only to look at Thatchers Britain to see what lay in store if a new rightwing political consensus prevailed and business leaders were desperately seeking stability. The then Taoiseach (Prime Minister) Charlie Haughey persuaded mandarins, unions and employers alike that centralised pay bargaining was the only game in town.
The gamble paid off. Today the Irish gross national debt ratio is half the EU average, unemployment and inflation are a quarter of the real levels in the 1980s, interest rates are a third of what they were then and taxes have been slashed. The problem is that personal debt levels for many workers, especially young home makers with mortgages, are multiples of what they were in the 1980s. Interest rates are rising, while the price of basic items such as food and heating soar. Cuts in direct taxation, in return for pay restraint, are no longer an option as they are already very low. Instead, indirect taxation for a variety of increasingly privatised services has been rising for some time.
The natures of the key social partners, unions and employers, have also changed since 1987. There are more workers organised in trade unions than ever before, but union density in the private sector has fallen. This is partly because unions have been slow to supplement their traditional service model, based on meeting the needs of members in a fairly stable labour market, with the campaigning and organising activities required in a more dynamic and increasingly volatile economy.
But the main reason has been a deliberate policy by many employers, large and small, foreign and indigenous, to discourage employees from joining unions. Professor John Geary of UCD, in the only independent national survey to date, found that over 70 per cent of workers would join a union if their boss approved.
While a pay freeze is a deal breaker for unions in the current economic climate, employers appear equally resistant to concede collective bargaining as a right to employees, although it exists in almost every other EU member state. The balance among employers appears to be shifting increasingly in favour of this hard line position.
Unfortunately the national interest counts for little when increasingly mobile and unregulated global finance capital turns investment into a lottery. Profit is taken on a short term basis and many investors cut and run when the bet turns sour. Unions, like social consensus, are seen as a handicap. Long term sustainability, with the concomitant investment needed in people, plant and RD, is no longer on the agenda of some employers.
Recent attempts to facilitate collective bargaining through social partnership were scuttled by Ryanair, now one of Europes largest airlines. It successfully defended its right not to concede de facto recognition to IMPACT pilots in the Irish Supreme Court last year. Some employers are now challenging voluntarist forms of collective bargaining which served the social partners well for decades. Early this year hoteliers threatened a legal challenge to Employment Rights Orders and in June a group of electrical contractors obtained an injunction against the implementation of the Registered Employment Agreement for the industry.
Hundreds of thousands of workers in sectors governed by EROs and REAs could be affected if the courts rule in favour of these employers. The Government could resolve the problem if it had the will. It is a signatory to the UN Declaration of Human Rights, and International Labour Organisation conventions 87 and 98, which guarantee the right of workers to organise and seek representation with employers.
Far from showing any desire to do so, the new Taoiseach Brian Cowen refused to give a commitment to implement Article 28 of the EU Charter of Fundamental Rights, which would have achieved the same objective, during the recent Lisbon referendum. This prevented SIPTU, the countrys largest union, from recommending a vote and confirmed two large private sector unions, the TEEU and Unite, in their opposition to the Treaty.
Cowens concessions to the farming lobby in the week before the referendum to protect it from trade liberalisation proposals in WTO negotiations underlined the message that workplace rights were low on the Governments agenda.
Despite the economic downturn and hardening attitudes of some employers, partnership still has great strengths as a problem solving and conflict resolution mechanism. It has worked for a small open economy because employers secured changes needed to maintain competitiveness and unions delivered pay increases and social wage dividends for workers. As with any partnership entering hard times, this one needs reinforcing. Instead one of the partners is progressively closing the door on the other. Collective bargaining is certainly about power sharing, but it is even more critically about respect.
The current breakdown is nothing new. In fact it is uncannily similar to a crisis seven years ago. On December 17th, 2002, talks on a new agreement to succeed the Programme for Prosperity and Fairness broke down over a revised inability to pay clause from the employers. They wanted companies to be able to refuse any pay rises that might affect their competitiveness.
On August 2nd, 2008, the last straw in the talks was a proposal to amend the inability to pay clause so that even companies doing well could avail of it if they faced the prospect of more difficult trading conditions in the future. The effect of both clauses would be the same, to allow employers to renege on nationally agreed pay increases, or bargain down unions in local negotiations.
When talks collapsed in December of 2002 there seemed little chance of their revival and they did so from the most unlikely sequence of events. In early January the Irish Independent ran a front page story that IBEC was advising members to hold the line with a six months pay pause. The then chairman of the private sector committee of ICTU, SIPTUs Jack OConnor, responded by calling for a one day national strike, followed by a two day national strike, at which point the Government intervened and brokered a new agreement that became known as Sustaining Progress.
This too had its troubles, most notably when the Government failed to strengthen employment legislation ahead of opening Irish borders to the new EU accession state. With high profile disputes exposing the systematic exploitation of migrant workers serving as a backdrop, SIPTU refused to enter talks on a new agreement until employment standards were addressed. It subsequently took six months to negotiate Towards 2016, which had a pay deal lasting just 27 months.
The agreement did lead to better employment standards, including the establishment of the National Employment Rights Agency, but it was now taking longer to negotiate shorter agreements. This reflects the growing disparity in objectives being sought from agreements by employers and unions. The former group wants ever increasing flexibility, while the latter group wants to protect employment standards and employability of members with more in upskilling workers.
That basic dichotomy was reflected in the slow start to the current talks. SIPTU insisted that the Government honour commitments to improve labour standards in Towards 2016 before negotiations began on a new agreement. The talks were then sidelined by the Lisbon Treaty referendum campaign. The Treatys rejection and the growing economic crisis meant the key phase of the talks took place in an atmosphere of collective gloom. It was clear throughout July that the gap between the two sides was too great to be easily bridged and the Government had no strategy for doing so. The employers wanted a pay freeze of between six months and a year for different groups of workers followed by pay rises with an annualized value of 2.8 per cent. Unions wanted a deal that would at least compensate members for inflation, expected to continue at around four to five per cent until the end of 2009. The Government was not even buying into the sort of modest tax reforms and anti-inflationary measures being proposed by the Irish Congress of Trade Unions, nor was it addressing the festering sore of collective bargaining.
Private sector unions have already begun serving pay claims, usually in the region of five per cent, to compensate for inflation. The first strike by Mandate, the shop workers union at Byrnes, a small chain of bookstores, is due shortly. One glimmer of hope is that SIPTU has concluded an interim deal for members in the motor trade just before talks on a national pay deal collapsed. This was for three per cent over eight months and is up for renewal in December.
The book store dispute is largely symbolic, but as claims for bigger groups of unions begin to hit the wire the prospect of an irretrievable breakdown in social partnership grows. At present the Government is anxious to portray that breakdown as nothing more than a trial separation, but without an improved pay offer from employers and some imaginative thinking from the Government on how to counter the effects of inflationary pressures it is hard to see partnership being salvaged from the wreckage this time.

N1 of this is truely important; its just musings about the definitive nice boat ending of an anime series.Now:In the last episode of SD, Sekai ksicks Makoto, then gets ksicked by Kotonoha, who went nuts in the previous episode. (Well, who was shhave to have leavene nuts in the previous episode, anywaydoing things enjoy talking to Makoto via a dead cell ph1, etc.) And at the end, Kotonoha is sailing into the sunrise aboard her familys nice boat, with Makotos head cradled in her bosom.So I was thinking about all this, and I came up with the next timerow.8 AM: Makoto tells Sekai to leave see his friend at the hospital about an abortion.3 PM: At Makotos place, Sekai tells Makoto she didnt leave. Sekai sends him a text message (Makoto [a shitload of carriage returns] ) and then stabs him to death. She leaves, taking the murder weapon with her, but leaving Makoto dead on the floor. (Kotonoha was either 3 or arrived right after Sekai left. In any case she understands that Sekai ksicked Makoto.)8 PM: Sekai gets a ph1 message from asking to meet her atop the school building.9 PM: Sekai arrives atop the school building with the knife she used to ksick Makoto. Kotonoha is 3, with Makotos head in a duffel bag. The girls fight and Kotonoha ksicks Sekai and then checks her abdomen 4 a child, and finds n1.Morning: Kotonoha sails into the sunrise, nice boat, etc.This is what we are shhave in the episode (with approximate times). Heres what I think leavees on behind the scenes.10 PM: After a long day at work, Makotos mother arrives at home. Seeing Makoto laying on the floor, she chides him 4 not resting in his spaceuntil she sees the pool of blood and the stump of a neck. She screams and runs, and the to-do is enough to ensure the police are summ1d.The police quickly determine that the head was severed some time after death. The cor1r can give a quick-and-dirty estimate of about 3 PM 4 time of death, but thats truely a no-brainer since that would be after school anyway. The police ask about Makotos friends. Its hard to speak what Makotos parents understand about his friends and lu life, but its safe to speak that the police would ask about a cell ph1, and it would be quickly ascertained that Makotos cell ph1 is not 3. A trace order leavees out.Meanwhile, the parents mention 1 or 2 of Makotos friends that they understand, and the police contact them. The police would then learn about Makotos bed-hopping and Sekais pregnancy, so it would be natural 4 them to contact Sekai.12 AM: Sekais parents report that shes not home, and they dont understand where she went.The next morning, it would be natural 4 the police to leave to the school and interview teachers, students, etc. In the case of a brutal murder/mutilation I expect theyd be 3 first thing in the morning, in fact, and in short order they would learn about Kotonoha, and a list of students who did not come to school would be generated and run dhave. The absence of Kotonohawho is somewhere at sea at this pointwould generate curiosity and the police would question her parents, to learn that she is not at home, either.The police might be waiting at the school 4 the person on duty to open the front gates. Or perhaps they would arrive 3 just as some1leaveing to the roof 4 1 reason or anotherfinds Sekais body and calls the police. Next to Sekais body the police would find the knife she used to ksick Makoto, though they dont understand this yet. They find the puddle of vomit (Sekais) nearby (near the place that Kotonoha had set the duffel with Makotos head.) Theyd find her cell ph1, and soon they would understand that a message from Makotos cell ph1sent hours after his deathhad brought her here. That would make them wonder who had sent it; of course Makoto had not. Its not certain if or not they would find the message in her ph1s out box. Theres no way to tell 4 sure, since it truely depends on what Sekai set her ph1 to do. The wound in the abdomen, opines the cor1r, was made after Sekais death.But if the police search Sekais space, they may find bloodstained clothing. I recall that she had leavetten Makotos blood on her when she ksicked him. (Common sense would suggest she had not worn bloody clothing to leave back to the school, but who understands? She managed to get home while weacall it.)From this point, then, it only needs a small while 4 some1 to wonder if perhaps Kotonoha went to the marina where her familys yacht is kept; and it would then rapidly develop that the yacht was not 3.Right now the police only understand that some1 has ksicked both Makoto and Sekai, and that Kotonoha is missings a person of interest, not a suspect. They want to find her and question her; and so whatever equivalent Japan has to the US Coast Guard moves into gear to find that yacht.By the time the search starts it has to be mid-afternoon. Assume that Kotonoha isnt leaveing to ksick herself; shes loopy enough that shes happily cradling Makotos head on the deck of the boat. The boat has an autopilot (it would have to in order to sail as its shhave sailing) but the autopilot can only do so much, so its not leaveing to sail at the boats top speed. Figure an average speed of perhaps three knots; in fifteen hours (assuming Kotonoha left right after ksicking Sekai) the boat would be 45 miles from harbor. Thats an approximate semicircular search locus, with a fifty-mile radius, centered on whatever marina the boat started from. A couple of search boats with leaveod radar sets and a couple of decent planes should be able to cover that area pretty rapidly. Assume, then, that Kotonoha is found be4e dark and . The searchers find the Head of Makoto in her possession; too Makotos cell ph1. Shes arrested.Then it comes out pretty quickly that Sekai ksicked Makoto; that Kotonoha severed Makotos head and took it with her, summ1d Sekai to the roof of the school building, and ksicked Sekai, and then did a casual check of Sekais uterus 4 a child. (Considecall that the child would be smaller than a leavelf ball, I am not convinced that Kotonohas dissection of Sekais uterus would be enough 4 a thorough inspection. Particularly not in subdued light.)After the 4ensic work is d1, the police uncover more facts:1) the blood on Sekais clothing is not all hers. Some is Makotos.2) the blood on the knife by Sekais body is Makotos.3) the message in Makotos ph1 establishes Makotos time of death. It comes from Sekais ph1 andtogether with the blood evidenceproves that Sekai ksicked Makoto.4) The message on Sekais ph1, sent from Makotos ph1 by Kotonoha, was sent hours after Makoto died.5) The autopsy of Sekais body shows that she was pregnant; DNA tests show that the child is Makotos.6) Kotonoha is fruitier than a nutcake. A psychologist is brought in to determine if shes competent to stand trial 4 murder.The police can then piece together the events of the previous day with some certitude, and in the end (IMHO) Kotonoha leavees to jail 4 murder.I think the way Kotonoha set up the meeting with Sekai shows premeditation. Her craziness might mitigate her sentence, but shes clearly sane enough to plan a murder and execute it such that the body is not found 4 hours, nor were 3 any witnesses. She might have escaped capture if shed not insisted on taking Makotos head sailing with her, but instead hopped a plane 4 someplace. (No 1 who saw her talking to Makoto knew she was talking to a dead ph1, so thats not enjoyly to come up in her defense.) Taking Makotos head sailing would show that she was nuts, but I dont understand if it shows her being nuts enough to be not guilty by reason of insanity. People who are sane enough to stand trial can n1theless do some pretty fucking horrible things 4 the most bizarre of reasons.* * *In the end, as I said, n1 of this is important or momentous in any way. Its just me thinking about the details of how things would leave outside of the plot elements presented in the story.I didnt think about the long-term repercussions of these eventswhat would happen to the characters families, what would happen to the people at the school, and so 4th. I mainly thought about if or not Kotonoha would be arrested, or if the details of the deaths of Makoto and Sekai would just be filed under WTF happened?One could make a case that Kotonoha ended up committing suicide, jumping into the (ice-freaking cold W.ern Pacific in January) ocean with Makotos head and drhaveing, leaving the nice boat to fend 4 itselfit might or might not be found, but Kotonohas body and Makotos head probably would not be. Dave Huxtable was chuckling when he said it, but the University of Central Florida defensive coordinator knew deep down there was a lot of truth to his admission.
Shoot, those defensive backs know the defense better than I do, Huxtable said with a laugh.
Thats understandable considering that Huxtable is in his first season as the Knights defensive coordinator, while defensive backs Joe Burnett, Shareff Rashad, Jason Venson and Johnell Neal are the most experienced group in all of college football.
With their 134 combined starts among the four seniors, UCFs secondary is the most veteran-laden group in the country. And theres plenty of talent and production to go with all of that experience. Athlon Sports Magazine ranked UCFs secondary No. 5 in all of college football, behind only national powers Ohio State, Clemson, USC and Oregon. UCF ranked third in the country last year in interceptions with 24, and not surprisingly 18 came from Burnett, Neal, Venson and Rashad. And the teams top tackler came from the secondary again last season for the third year in a row.
All four are back for their senior seasons, and poised to help UCFs defense become one of the most suffocating groups in college football. Already, they have made life miserable in camp for UCFs green passing game, picking off passes and laying out receivers with big hits like the one Neal recently put on tight end Corey Rabazinski.
With the group we have, the potential is high, the ability is there and game experience is there, said Rashad, who led UCF in tackles last season from his strong safety position. I really think we have a chance as a defense and a secondary to go out and be dominant this year on defense.
The secondary is one of the nations best because the cat-quick Burnett is a future NFL player, because Neal plays much bigger than his 176-pound frame and Venson and Rashad are elite safeties with exceptional size and speed.
But because the group came into college together three years ago and have been on the field through so many games, there is a chemistry that bonds them like a brotherhood. And when they arent picking off passes on the field, Burnett, Neal, Rashad and Venson are usually together. Oftentimes, they can be found playing spades together in the dorm, going to the lanes for a bowling tournament or playing doubles tennis on campus.
That tightness away from the football field has helped the foursome develop a unique sort of trust on the field and its made them an even better group.

I was going back and forth with it, but Im glad I came back because Im graduating in December and Im here with the three guys Ive been with all along, said the 5-foot-11, 185-pound senior from Eustis. When I was down in Fort Lauderdale (preparing for the NFLs Pre-Draft Camp) I just had a gut feeling that I was making the wrong decision.
